General Event Conditions
General Event Conditions (GEC)
1. Conclusion of contract
By sending the registration form and/or by confirmation from an authorised person or body, the contract between the parties is legally valid.
Equilas reserves the right to cancel the course due to insufficient number of participants. No claims against Equilas can be made on this basis. The participants will receive a replacement or a refund of the seminar fee.
3. Scope of service
Upon conclusion of the contract, Equilas undertakes to provide the services described in the tender and also published on www.equilas.ch. This includes e.g.: Communication before and after the course, conducting the course and providing the documents required for the course, such as worksheets or case studies. The presentations used in the course will be provided either physically or electronically. The service does not include textbooks for course preparation.
4. Power adjustment
Equilas reserves the right to adapt the performance to the prevailing market situation and make appropriate changes.
5. Duration and termination of contract
The contract concluded is for a specific training course with a predetermined duration.
Due to high costs and efforts caused by course cancellations shortly before the start of the course, the following cost absorption rules apply for cancellations:
• Cancellations 30 – 11 days before the start of the course: 50% of the costs
• Cancellations less than 11 days before the start of the course: 100% of the costs
The participant or the employer of the participant concerned is responsible for paying the stated cost shares. Cancellation fees do not apply if a substitute person attends the course. The personal details of the substitute person can be announced by the notification of change.
7. Exchange rate settlement (Payment of the seminar costs)
The courses are either to be paid in advance or will be invoiced one day after the course with a payment deadline of 30 days. Equilas reserves the right to determine the method of invoicing in each individual case.
8. Personal data
All course participants of Equilas are informed by the GEC that their data will be stored electronically for processing purposes (e.g. information on new courses, list of participants, etc.). The provisions of the data protection legislation will be observed. To this extent, the participants agree to the processing and use of their data.
If the course participant does not wish his name to be published, he must inform Equilas in writing or by e-mail before the course takes place.
The presence of the participants during trainings may be recorded on photographs or other data carriers. Individual recordings are used in internal or external publications (including the Internet). Should a participant not agree to this, he/she must contact Equilas within one month.
10. Place of jurisdiction
For disputes arising from this contractual relationship, the place of jurisdiction for both parties is Bern.
